With so much controversy on new state legislation regarding women's reproductive freedoms the views of Elena Kagan, supreme Courth nominee, have become increasingly important. Recently, memos regarding her stance on partial birth abortion bans have been published on the internet.

With the prospect of adding her to the bench, Elena's views on social issues could evidince her take on abortion as well. Although she supported a ban of military recruits on college campuses due to the discriminatory nature of the "Don't Ask Don't Tell" policy, she fought strongly for steeper cigarette taxes and more comprehensive bans on smoking.
