Government Will Challenge Abortion Decision -- Trial To Take Place in St. Louis
The "Partial Birth Abortion Ban" passed by President Bush has been declared unconstitutional three-times been since his signing one year ago. Despite that fact, the Justice Department announced on September 28, 2004 that it will appeal a Nebraska judge's ruling striking down the ban.
The Justice Department refuses to accept the ruling of U.S. District Judge Richard Kopf who declared that the ban interferes with the right to an abortion and fails to allow exceptions when a woman's health is in danger. The Justice Department's challenge to the ruling brings the case to Missouri before the 8th U.S. Circuit Court of Appeals in St. Louis.
It is widely expected that the Justice Department, headed by Missouri's own John Ashcroft well-known for his virulently anti-choice views and his public opposition to Roe v. Wade, will not stop until one of these cases is before the U.S. Supreme Court.
